BeenSend Terms of Service

BeenSend provides a subscription-based platform only for responsible, permission-based marketing email campaigns. These terms explain what the service covers, what is forbidden, and what happens if rules are violated.

Opt-in marketing onlyNo bulk or mass-blast emailNo transactional emailNo purchased or scraped lists

1. Scope of the BeenSend service

BeenSend is an email marketing software platform for creating templates, managing opted-in subscribers, scheduling marketing campaigns, using marketing automation, and reviewing available campaign reports. Services depend on the chosen plan and configured delivery provider.

Marketing-only platform

BeenSend does not provide a transactional email service or unrestricted bulk email marketing service. Sending credits are usage allowances, not authorization to send mass mail, unsolicited advertising, or automated application notifications.

Allowed

Relevant newsletters, promotional updates and customer marketing to recipients who have affirmatively opted in, at approved operational volumes.

Not allowed

Mass-blast or bulk-email distribution, purchased/borrowed/scraped contacts, unsolicited outreach, and any message sent without adequate recipient permission.

Not allowed

Transactional or system-generated messages such as OTPs, password resets, receipts, purchase confirmations, invoices, service alerts or application notifications.

2. Account registration, eligibility and customer obligations

You must provide accurate registration and billing details, keep credentials secure, and use the service for lawful business activities. You are responsible for all users, subaccounts and activity within your account.

  • Confirm that your email purpose fits the marketing-only policy before uploading a list or launching a campaign.
  • Maintain proof of permission for every subscriber: signup source, date/time, consent language and reasonable supporting evidence.
  • Identify the sender accurately and use a real reply-to address, verified sending identity and an accurate business contact method.
  • Maintain functioning unsubscribe controls and promptly honor withdrawal of consent.
  • Comply with applicable marketing and privacy rules, including CAN-SPAM, GDPR, PECR or other laws that apply to your business and recipients.

3. Prohibited sending and data sources

The following are strictly prohibited regardless of whether the plan shows unused monthly credits:

  • Bulk or mass-blast marketing campaigns, including automated high-volume distributions that bypass usage or anti-abuse controls.
  • Sending to lists purchased, rented, shared, traded, scraped, harvested from websites/social platforms, or collected by third parties without valid, documented consent for your specific sending organization.
  • Cold outreach or unsolicited promotions to recipients who did not request marketing from you.
  • Transactional email, password resets, one-time passwords, two-factor authentication, purchase/order confirmations, account/security alerts, invoices or operational/system notifications.
  • Misleading From names, deceptive subject lines, impersonation, forged headers, phishing, scams, malware, harmful attachments and fraudulent claims.
  • Promotion of unlawful goods or services, hate or harassment, deceptive financial offers, illegal gambling, exploitative content, or content that violates intellectual property or others’ rights.
  • Circumventing unsubscribe requests, suppression lists, bounce blocks, domain verification, rate limits, account reviews or suspension actions.
Permission is not a bulk-sending exception

Even if contacts have opted in, BeenSend is not positioned as a bulk-mail blasting service. Any permitted campaigns must remain within service usage rules and operational safeguards.

4. Consent, subscriber information and privacy

Customers act as the organization responsible for deciding why and how recipient addresses are collected and used. BeenSend and its subprocessors process information as required to operate the platform, subject to applicable arrangements.

  • Do not assume a prior purchase, publicly listed address, imported CRM record or social media connection equals consent to promotional email.
  • Be able to demonstrate the origin and scope of each contact’s permission on request.
  • Stop contacting anyone who unsubscribes, objects, or withdraws consent where applicable; maintain suppression records.
  • Keep lists accurate and appropriately retained; remove invalid, irrelevant and unpermitted addresses.
  • Review the Privacy Policy and GDPR and data processing information for further details.

5. Service plans, sending credits and restrictions

Subscription fees, included sending credits, domain allowances and plan duration are shown on the Pricing page and at checkout. Credits are maximum plan allocations, not promises of unconditional sending throughput or guaranteed inbox placement.

BeenSend may apply account reviews, technical rate limiting, identity verification, abuse prevention, or provider-specific restrictions regardless of the headline allowance. Transactional, unsolicited or bulk-blast sending remains prohibited on every plan, including any enterprise or custom arrangement.

Charges, renewals, cancellations and refund entitlements are governed by the actual checkout terms, payment provider terms and mandatory applicable laws; do not infer a refund guarantee from these pages.

6. Delivery, hosting and no inbox guarantee

BeenSend uses AWS infrastructure for application hosting. Campaign delivery depends separately on configured sending providers, verified domains, network availability, recipient mailbox policies, list quality and authentication records. No specific inbox placement, delivery percentage or uptime is guaranteed by these terms.

Customers must configure sending identities correctly and address bounces, spam reports and authentication failures promptly. Read our Email Deliverability page and AWS Infrastructure page.

7. Monitoring, investigation and enforcement

To protect recipients and service infrastructure, BeenSend may investigate suspected violations and apply proportionate controls, subject to applicable law and contractual commitments.

  • Pause or restrict sending, temporarily suspend campaigns, or request identity/consent evidence.
  • Reject or suppress unsafe recipient data, block offending domains or content, and remove unauthorized activity.
  • Suspend or terminate accounts for serious or repeated policy breaches, including spam, fraudulent use, transactional sending or prohibited bulk campaigns.
  • Cooperate with delivery providers, infrastructure vendors and lawful authorities when legally required.

We may request remediation before restoring service. We do not guarantee reinstatement after a serious violation.

8. Intellectual property, policy updates and contact

Customers retain rights in their own lawful campaign content, subject to the necessary rights to process it through the platform. They must not upload content they lack permission to use. We may update these terms to respond to platform, legal or abuse-prevention changes, with notice where applicable.
